    The following letter is from Jesse Marshall Chitwood to his wife, Rosaline Stroud Chitwood, date 2-6-1863, written just 12 days before his death in Wilson Hospital, NC
    My Dear Rossaline
    I write you a few lines this morning since I wrote to you last which was last Saturday, I have had a spell with that old pain in my side you remember about it I was bad off with it all night the Doctor said it was cramp Colic but I am doing as well as ever but I tell you I am very weak yet. I can not walk more than a hundred yards without resting it will be a good while before I go back to the Regiment I have not heard from the boys since I left them I think I am doing well but I have took so much medicine I am very weak and will take time to get (begins second page) I did think I would try to get to come home while I was sick but the Doctor wont let no body have a furlough I wrote to you about sending for Cooper. I hope you send without delay and have him at work no difference about the old Niger not liking to stay don't listen at that, send for him as soon as you can. I think I will be home to stay before long this war will stop before long I think so let Coop start me a crop. Rossa I feel like I will see you and my little children and live with you again tell mother I have often thought of her since I have been sick I must close, direct to Wilson Hospital NC I remain your devoted Marshall (footnote: there is a postscript written in the the top margin of the second page of the letter which says :"Tell Sarah Bob Havrick is here not much the matter and Jim Pitts Depriest they are most alike I can hardly tell them apart Bob says he has Chills.")

    Jesse Chitwood is the son of James Chitwood and Elizabeth Whiteside. He married Sarah Horton on October 7, 1817 in Rutherford County, North Carolina, and they had at least eight children. He was drafted into the military during the War of 1812 in March 1814 in Rutherford County, NC for six months. He served as a private in the 7th Regiment (Pearson's) NC Militia. He received two land grants in Rutherford County, one on Hinton's Creek and one on Sandy Run Creek. He has eight siblings.

    Notes:

    Capt. James Chitwood, son of Matthias and Mary (Key) Chitwood and brother to Richard Chitwood, was a Tory during the Revolutionary War and was captured and hung after the battle of King's Mountain NC. "The names of the condemned Tories were --- Colonel Ambrose Mills, Capt. James Chitwood, Capt. Wilson, Capt. Walter Gilkey, Capt. Grimes, Lieutenant Lafferty, John McFall, John Bibby, and Augustine Hobbs.

    They were swung off the Gallows Oak, three at a time, and left suspended at the place of execution. According to Lieutenant Allaire's acocunt, they died like soldiers --- like martyrs, in their own and friends' estimation. "These brave but unfortunate Loyalists', says Allaire, 'with their latest breath expressed their unutterable detestation of the Rebels, and of their base and infamous proceedings; and, as they were being turned off, extolled thier King and the British Government, Mills, Wilson, and Chitwood died like Romans.....The poor Loyalist leaders had been left swinging from the sturdy oak upon which they had been executed. No sooner had the Whigs moved off, than Mrs. Martha Bickerstaff, the wife of Capt. Aaron Bickerstaff who had served under Ferguson, and been mortally wounded at King's Mountain, with the assistance of an old man who worked on the farm, cut down the nine dead bodies. Eight of them were buried in a shallow trench, some two feet deep; while the remains of Capt. Chitwood were conveyed by some of his friends, on a plank, half a mile away to Benjamin Bickerstaff's, where they were interred on a hill still used as a grave-yard."     James Chitwood was a Loyalist and Officer (Captain) during the Revolutionary War living in South Carolina.

    As depicted in the book King's Mountain and its Heroes by Lyman C Draper;

    The Battle of Kings Mountain (SC) was a decisive battle and turning point in the Southern Campaign of the American Revolution. British Officer Colonel Ferguson had taken up position on the top of the mountain with Loyalist militia from South Carolina but were overwhelmed in the battle on October 7, 1780 by Patriot militia "Over Mountain Men". Over 400 Loyalist were killed or wounded in the surprise attack by the Patriots. Ferguson was the only British soldier and he died in the battle that lasted about an hour. Over 600 were captured including 9 officers. One of those officers was Captain James Chitwood.

    The Patriots retreated quickly with the prisoners north into NC. The set up camp and tried and sentenced 39 men to be executed in an infamous proceeding. Three at a time they were hung from a large oak tree known after as the Gallows Oak. Captain James Chitwood was in the first group of three to be hung. With nine hanging from the tree, and three more ready to go a disturbance occurred that caused the hanging to be discontinued and the remaining to be pardoned.

    The men had been left swinging from the sturdy oak but as soon as the Patriot force moved off, the wife of Captain Biggerstaff (or Bickerstaff) who served under Ferguson and been mortality wounded at the battle, cut them down with the help of a farm hand. Eight were buried in a shallow trench and the remains of Captain Chitwood were taken to the Biggerstaff farm and interred on a hill there.

    A statement made 21 Jan 1828, by Thos. S. Whiteside, Administrator of Estate of Elizabeth Hubband, deceased: "to the best of his knowledge there are Six heirs of Elizabeth Hubberd now in being: James H. Whiteside; Sally Whiteside, married with J. Massey; Caty Whiteside; Adam J. Whiteside; Thomas S. Whiteside; and Rosannah Bond intermarried with Charles Laughlin."

    To prove title to land already sold, a Deed of Partition for estate of Elizabeth Hubbard, dated 1853 in St. Louis Co, MO, (a quarter century after her death): "... that Rosanna Laughlin wife of Charles Laughlin, another of said heirs, had died leaving her husband Charles Laughlin and her children: John Laughlin, Elisabeth Laughlin and who reported to have married one Alfred Wilson...., HENRY LAUGHLIN, America Laughlin and Rosanna Laughlin, as her heirs at law, infants, who are minors under the age of 21 years, as they believed and who were incapable of perfecting the title to the said several tracts and pieces of lands...[Henry and siblings were minors in 1827 when Elizabeth died].
