    Notes:

    Captain John Rogers, the first of this family in Virginia, was born about 1620, since on 4 Aug. 1665 he stated his age was 45. Transported to Virginia 18 April 1638. He purchased 250 acres in Northumberland County from James Claughton on 20 Jan. 1652/3 and on 13 Sept. 1654 took out a patent for 50 acres on the south side of Claughton's Creek adjoining this land and also for 250 acres adjoining. He became a justice of Northumberland County in May 1655, was a captain in the militia, and was a vestryman of Chicacone Parish. On 1 May 1665 he took the appointed oaths as Sheriff for the ensuing year. On 30 Nov. 1656 Capt. John Rogers repatented the 300 acres he had originally patented in 16 54. He added another 200 acres on 31 Aug. 1657 and on 9 Jan . l662/3 repatented this land and his 250 acres originally patented in l654. The name of his first wife Ellen is shown on the tombstones of both husbands of their daughter Elizabeth (Rogers) Keene Banks at Cypress Farm, Northumberland County. Before Sept. 1668 he married his second wife Anne (______) Temple Clay, widow of John Temple and Francis Clay.

    BIOGRAPHY: Resided Cypress Farm, Lewisetta, Virginia.

    John Rogers' will was presented for probate on July 21, 1680, but is no longer of record in Northumberland County.

    John Rogers was a captain in the militia, he served as justice of Northumberland County in May 1655, and was a vestryman of Chicacone Parish. On May 1, 1665, he took the appointed oaths as Sheriff for the ensuring year.

    Northumberland County, Virginia, Court Order Book 1666-1678, page 137, 20 Dec 1671, Pet Lehoot, servant to Captain Jno Rogers is adjudged to be 9 yeares of age & ordered to serve his sd Master according to Act.

    Ellen Heale's will, dated 15 Oct 1710, bequeathed her son William 500 acres unless he died without issue; then it would go to Joseph, or to Ellen, Elizabeth, and Sarah. Ellen she gave 100 acres at Cherry Point. To William she gave three slaves, the furniture in her chamber and her stock of cattle and hogs, as well as her brandy still. Sons John and Joseph were given the money they owed her. Slaves and personalty were given to her daughters Ellen, Elizabeth and Sarrah. Hannah was given 5 pounds sterling; George a silver hilted sword and belt which were his father's, and Nicholas 20 shillings sterling. Her books were to be divided equally among her daughters and William.

    13 Dec 1710: The will of Ellen Heale was dated 15 Oct 1710 and proved on 13 Dec 1710. In the name of God amen, I Ellen Heale of the Parish of St. Mary's White Chappell in the County of Lancaster --- being Sick and weak of body but praised be God of sound mind and ___ memory and considering the frailty of this mortal life and that all flesh must submit unto death when it shall please God to call me therefore make this my last will & testament in manner & form as fol-lows and first being truly and heartily sorry for all my sins past I recommend my soul unto the hands of almighty God my maker trusting and assuredly believing that I will be saved by the meritorious death and passion of my only savior the Lord Jesus Christ and my body I commit to the earth from whence it was taken to be decently interred according the discretion of my executor hereafter named and as for my temprall estate I give and dispose thereof as follows, Imp. It is my will and desire that all my just debts and funeral rights be first paid and discharged. Item, I give and bequeath unto my son Will. Heale and the heirs of his body lawfully begotten forever all that parcel of land I lately bought of Mr. Thomas Taylor and Elizabeth his wife lying upon the branch of Capt. Richard Balls mill swamp containing five hundred acres as by the deeds for this land recorded in this county will___. Item I give and bequeath unto my son Wm. my lot of land in Queens Town together with all its houses and appurtenances to him the sd. Wm. Heale and the heirs of his body lawfully begotten forever and if in case sd son should die without such issue then it is my will therefore and I hereby give and bequeath all that tract of land containing five hundred acres _____ my town lot hereby given to my son Wm. unto my son Joseph Heale and his heirs lawfully to be begotten forever and if it should please God that the sd Joseph Heale should die without such heirs then I give and bequeath the same to my three daughters Ellen, Elizabeth, and Sarah Heale to be equally divided amongst them and their heirs forever. Item, I give and bequeath unto my loving daughter Ellen Heale one hundred acres of land lying at Cherry Point formerly given to me by my mother as by a Deed of gift for the same recorded amongst the records of that county___to her the sd Ellen Heale and the heirs of her body lawfully to be begotten forever and for want of such heirs I give and bequeath the sd one hundred acres of land to my daughter Elizabeth and the heirs of her body lawfully to be begotten forever and in case the sd Elizabeth should die without such heirs, then I give the sd one hundred acres of land unto my son John Heale and to his heirs forever. Item, I give to my son Wm. Heale and his heirs forever one negro woman named Yarabal and one negro girl named Nancy and one negro boy named Guy which the son and daughter of sd Yarabal and one negro man named _____ with all their future thereof ____ to him the sd Wm. and his heirs forever aforesaid. Item, I give and bequeath to my son William Heale my bed and all its furniture as it now stands in my chamber and ye stocks of cattle and hogges ____ belong to the plantation upon ye fore mentioned five hundred acres of land to ye sd. Will. also one brandy still with its (Capp ?) worm tubb and all its appurtenances whatsoever. Item, I give to my son John Heale all the money that he owes me which I loaned him upon his request. Item, I give to my son Joseph Heale all the money he owes me which I loaned him upon his request. Item, I give to my daughter Ellen Heale one negro woman named Bess to her and her heirs forever, also the chest of drawers which stands in my chamber and a suit Camblet curtains and vallences red and white. Item, I give to my daughter Elizabeth two negroes named Jack & Cherry with all her future _______ to her and her heirs forever as also one feather bed bolster rug and blankets and one old pare of green curtains and vallences and one oval table. Item, I give to my daughter Sarah one feather bed and bolster and one negro boy named Jacob to her and her heirs forever also one other negro called James. Item, I give to my daughter Sarah one old suit of curtains and vallences of Linsie Woolsey. Item, I give to my three daughters, Ellen, Elizabeth, and Sarah Heale and my son William one Doz. and half of new leather chairs to be equally divided between them. Item I give to my daughter Mrs. Hannah Ball, the wife of Capt. Wm. Ball, five pound sterling. Item, I give to my son Geo. Heale a silver hilted sword and belt which was his fathers. Item I give to my son Nicholas Heale twenty shillings sterling in full for his share of my estate. Item, I give my books to be equally divided amongst my three daughters first above named and my son Wm. Heale. Item, it is my will and pleasure that immediately after my decease my son Wm. be possessed _______ & singular the legacies hereby given to him and it is my desire that my loving sons John and Jos. Heale be overseers of him and his estate to advise him in the management of all his affairs until he shall arrive to years of _______ an _____ his own businesses and I do desire my sd sons to _____ him the said Wm. to _____ and ____ of anything of value during his minority without their or either of their ____ approbation. Item, I give my book entitled ____ County Justices to my son Joseph Heale. Item, whereas I have given to my son Wm. my feather bed and all its furniture as it now stands in my chamber it is my will and pleasure that he shall have it and every the curtains, vallences and all other the appurtenances as it stood in my chamber ______Eighteenth day of March last past when I first bequeathed the same to him at that time by my last will and testament _____ a rug and quilt thereto belonging. And lastly I do hereby nominate and appoint my sd sons John Heale, Joseph Heale and Wm. Heale, executors of this my last will and testament of three sides and ______ hereby revoking all or any will or wills by me heretofore made and this only I publish and declare to be my last will and testament and by witnessing the same ______ hand and seal this fifteenth day of October anno Dom 1710.     An inventory of goods taken according to the ------ and appraisement made of the estate of Mrs. Geo. Heale, late of this county of Lancaster, deced, by Capt. Hen. Fleet, Mr. John ----- and Mr. Jos. Tayloe and now delivered to Mrs. Ellen Opie, Eliza. Heale, Sarah Heale, and John and Jos. Heale for the use of Wm. Heale as part of their portions due to them from the estate of the above sd Mrs. Geo. Heale as followeth (see inventory of her husband, George). Received of Jos.     In his will, William left his son George and his heirs all his lands, giving him 10 Negroes ("and all their future increase"), "a Smith anvil & Vice, my best Saddle & Furniture, Pistols, Holsters, Silver Hilted Sword, my two Guns, Watch & Desk" and "negro boy Robin ("but if my son dies without lawful issue, the said negro boy Robin to go to my loving wife and her heirs"--why is this boy separated from the others?) His wife received six Negroes and the use of 5 others as well as 1/3 of the rest of the estate; his daughter Betty eight Negroes, his brother to keep the ones he gave him. George will receive his estate at 19, with his wife acting as guardian unless "my wife shall marry any one that proves unkind or careless of my children or their Estates."
