Will of Joseph LANE, Sr. - Morgan Co., AL
In the name of God, Amen-
I Joseph LANE Sen'r of Morgan County State of Alabama being of sound
mind and memory do make bublish (sic) and deliver this my last will and
Testament in the words and form following (to wit)
Item 1st/ I give and bequeath to my daughter Jane HIGH one hundred
dollars to her and her heirs forever.
Item 2nd/ I give and bequeath to my son Jesse A. LANE my quarter section
of land on which I now live with all the improvements thereon to him and
his heirs forever, Reserving to my beloved wife Pherebe LANE her dower in
said land
Item 3rd/ I give also to my son Jesse A. LANE one bed and furniture, one
horse worth one hundred dollars to him and his heirs forever, --
Item 4th/ I give to my beloved wife Pherebee lane all my household and
kitchen furniture except that I have already disposed of --
Item 5th/ It is my will and desire that my river tract of land shall be
sold by my executor at public sale and the proceeds of said sale applied
to the paying out and patenting the tract of land on which I now live --
Item 6th/ It is my will and desire that all my other property of what
kind soever after paying all my just debts shall be equally divided
between my beloved wife Pherobee LANE, my daughter Pherebee LANE, my
daughter Rebecca LANE and son Jesse A LANE except that the value of the
property heretofore given to my wife Pherebee LANE is to be taken from
her share in this division.
Item 7th/ It is my will and desire that all the property herein given to
my wife Pherebee LANE or which may fall to her in a division between her
and my other legatees shall belong to her during her natural life or
widowhood and after her death or marriage shall be equally divided
between my other legatees herein named, --
Item 8th/ the reason I have not given property by this will to my
daughters Delia BURT, my son Isaac LANE, my daughter Patsy BURT, my son
Joseph LANE and my son Jonathan LANE is that I have given to them
heretofore property of equal value --
Item 9th/ I nominate and appoint my sons Joseph LANE and Jonathan LANE
my true and lawful executors to this my last will and Testament hereby
revoking all former wills and Testaments and publishing and
declaring this my last will and Testament this 20th day of May 1825 --

At a special Orphans Court held for that purpose I Stephen Heard Judge
of Morgan County Court do hereby certify that the foregoing last will
and testament of Joseph LANE Senior deceased was proved before me by the
subscribing witnesses thereto & that the Testator was of sound mind &
memory at the time of the execution thereof
Given under my hand and seal this 2nd day of February 1826
